FAIRFIELD The parent of a student at Alamo Elementary School in Vacaville sued the Solano County Office of Education after she said she learned police were investigating whether her daughter, who is autistic and has cerebral palsy, was allowed to lay unsupervised in rain puddles for more than two hours.

The mother received a call from the school that her daughter, now 13 years old, had gotten her clothes wet Dec. 3, 2015, and that sheneeded to bring a change of clothes, according to the suit filed May 15 in Solano County Superior Court.

She discovered her daughters clothes were soaking wet in a backpack, the suit states.

The mother asked what happened and was told her daughter didnt want to stop bouncing a ball, pushed a teacher out of the way and ran out the classroom door where once outside she rolled around in the puddle, according to the suit.

The events as described surprised the mother because they were inconsistent with what she knows about her daughter, the suit states.

Her daughter lacks the muscle strength necessary to push an adult out of the way and the girl is not aggressive, the suit adds.

The mother was surprised that no behavior incident report was filled out, the suit continues, and she suspected the version of events was inaccurate.

She asked to visit her daughters classroom, but the Solano County Office of Education did not permit that until 11 days after the incident and a second visit was not permitted until Jan. 19, 2016, the suit states.

The mother received the impression that the county Office of Education did not want her to visit the classroom, according to the suit. She submitted a formal letter to the office March 6, 2016, asking for an investigation into the incident and interviews of adults present.

She was told an investigation would take place, but didnt hear again for a month from the Office of Education, the suit states. At an April 26 meeting, no investigation report was provided and no one from the Office of Education detailed the probe, according to the suit.

A month later, the office called to say a police report had been filed and law enforcement was investigating.

Victor Romualdi, assistant superintendent for student programs at the county Office of Education, said Thursday the county schools office is aware of the court filing but cannot comment because of confidentiality issues involving the student as well as personnel.
