Patient sues doctor, Aspen Valley Hospital for $4 million

A California man is suing Aspen Valley Hospital and its former chief surgeon for $4 million as part of a medical-negligence lawsuit filed last week in federal court. Laurence Niles, 79, of Pacific Palisades, California, claims the hospital botched its treatment of him after he was admitted to the facilitys emergency room Feb. 17, 2013. As a result, he suffers from permanent brain injury and needs constant medical care, the suit alleges. The lawsuit, which was filed Thursday in the U.S. District Court of Denver by Denver law firms Bogue Paoli & Thomas LLC and Ogborn Mihm LLP, comes after Niles attorneys gave the hospital notice on Aug. 12, 2013, that they planned to sue. The defendants are Dr. Bill Rodman, who could not be reached Monday, and the Aspen Valley Hospital District, which said it had not seen the complaint and declined to comment about it. Niles was admitted to the hospital with a severe head injury, multiple rib fractures and other ailments from a ski collision, the suit says. The cover of the February issue of National Geographic shows retired Marine Gunnery Sgt. Aaron Tam holding a mask that exposes a brain. It's a representation of Tam's own brain, a brain subjected to more than 300 blast force explosions, a brain also repeatedly probed by neuroimaging machines to diagnose his injuries. But the high-tech machinery of science can reveal only so much. It was the mask created in a program at the National Intrepid Center of Excellence (NICoE) at the Walter Reed National Military Medical Center in Bethesda, Maryland, that exposed the psychological pain caused by blast force-the insidiously invisible and signature injury of the Iraq and Afghanistan campaigns. THE family of a brain injury victim have thanked the Daily Record for forcing health chiefs to move their loved one to a specialist hospital. We told how Bill Douglas, 59, was trapped inside his hospital room at Glasgows Victoria Infirmary with a plank of wood jammed against the door handle. After the Record published a disturbing image of the makeshift barricade, Health Minister Shona Robison stepped in and forced local NHS chiefs to apologise. Robison said she was deeply concerned by the way he was treated. The Record covered the Victoria Infirmary barricading Bill in his room earlier this week And now Bill has been transferred to a specialist psychiatric unit by NHS Greater Glasgow and Clyde. A BRAIN injury victims family are demanding answers after finding him barricaded inside in a hospital ward. Bill Douglas, 59, has been in Glasgows Victoria Infirmary for four months. His sister Morag Douglas, 55, says she was horrified to find a plank of wood jammed against his door and a trolley barring his exit when she called to visit. The family fear Bill has been locked up because of a lack of specialist nurses. Hospital chiefs say the move was to protect him and others because there were issues with violent behaviour. Last night, national brain injury association Headway called for an urgent investigation into the case, saying Bills treatment was shocking, dangerous and highly inappropriate. Morag said when she got past the makeshift barricade on Friday night, she found no staff looking after Bill.
