MIDWIVES at a tragic home birth during which a girl suffered a devastating brain injury could not have done more to ensure her safe delivery, a top judge has ruled. The girl, now aged 13, was left with severe cerebral palsy and communication problems as a result of the catastrophic injury she sustained when she was born in 2003. Through her mother, she sued the Southend University Hospital NHS Foundation Trust for millions in damages, claiming the two midwives charged with her delivery were negligent. Her lawyers argued the girl could have avoided any injury, or suffered substantially less damage, had the pair realised her heart rate had rapidly dropped sooner and acted more swiftly to deliver her. But she will not receive a penny in compensation after her claim was today rejected by a judge at the High Court, in London, who found the tragedy could not have been avoided and was no-ones fault. Mrs Justice May said that, although the medical notes made during the birth were sparse, both midwives - who gave evidence during the hearing - said they had made regular observations of the mother and baby. A group of doctors in the city joined hands on Sunday to fight against Cerebral Palsy, a disease that occurs because of a neurological disorder. The initiative is significant as every three out of 1,000 children in Haryana suffer from some form of neurological disorder. The matter needs serious attention, said the doctors at a panel discussion held at a rehabilitation centre in Sector 42 on Sunday. According to the data put out by the World Health Organisation (WHO), 10% of the global population suffers from some form of disability. In India, 3.8% of the population is affected by disabilities. Whats even more worrying is that nearly 15-20% of the physically-disabled children in India suffer from Cerebral Palsy. In Haryana, stroke is seen as one of the leading causes of disability and death. A 12-year-old girl from Iraq,who has been suffering from Cerebral Palsy since she was 8-months-old, was administered a drug during the panel discussion. Dr Sumit Singh, consultant neurologist, Artemis Hospital, highlighted the role of rehabilitation and drugs in management of adult spasticity, which is known as Cerebral Palsy when it affects children. INSIDE EDITION - Tahj Oliver knew he wanted to ask his close friend to go with him as soon as his heard about the special needs prom at East Oswego High School in Illinois. Oliver, 18, befriended fellow senior Evelyn Araujo, who has cerebral palsy, when they were sophomores and the pair hit it off. "It just started one day," Oliver told InsideEdition.com. "I just said hi to her and that one day she could not stop smiling." They eventually began texting and became close. So when Oliver heard about the prom, he quickly started planning his "promposal" for Araujo. The 18-year-old held up a giant pink poster bearing the words, 'Can I have a pass to prom?' as Araujo entered one of the schools classrooms last month. "I asked her. She was so surprised and super happy," said Oliver. Oliver, who has cousins with special needs, said he knows how much the little things matter. Children whose weight at birth is very low or much higher than normal have a greater risk of suffering from cerebral palsy than average-size babies, according to British scientists. In a study that compared data from 10 European birth registers of 4 500 children born with the disorder, they found that babies with a low weight for their gestational age were four to six times more likely to have the disability. Very big babies had a threefold raised risk. "Babies that are the extreme of their expected growth, too big or too small, are at considerable increase of cerebral palsy," Dr Mary Jane Platt, a public health epidemiologist at the University of Liverpool in England, said in an interview. "That provides a clue to where we should look more closely for what might be causing cerebral palsy," she added. Instead of focusing on what happens during the birth, Platt suggests the cause of the disability could occur during the course of the pregnancy. Children with a slightly higher birthweight than normal had the lowest risk of cerebral palsy, according to the study published in The Lancet medical journal. An ethics professor at Princeton University has penned a controversial op-ed in defense of a Rutgers professor who was convicted of sexually assaulting a man with severe cerebral palsy, asserting that the two were in love and the man might have actually consented. The New York Times published Peter Singers article on April 3, which centered on the case of Anna Stubblefield, who is currently serving a 12-year prison sentence. Stubblefield was found guilty in October 2015 of engaging in sexual activity with a 29-year-old man named D.J., who is unable to speak. In addition to the criminal case, D.Js family sued Stubblefield in their belief that their son was molested and was awarded $4 million by a New Jersey court last year. Comments(0) A courageous nine-year-old who is battling cerebral palsy was given the special honour of officially unveiling a revamped store in her home town. Kareena Hayes hit the headlines in February after thieves stole a cafe's charity box set up to raise money towards a 10,000 target for life-changing private treatment at Queen's Medical Centre, to help her walk. But within days, the youngster was smiling again after an anonymous businessman heard of her plight and stumped up the money to pay for the operation. Now Kareena, a pupil of Longmore Primary School, in Long Eaton, has been given another boost after she and her fellow pupils helped to cut the ribbon and declare the new-look Co-op store in the town's Grasmere Road officially open, following a 600,000 refurbishment. As well as inviting Kareena and her classmates to be guests of honour, the store has also launched a fundraising appeal for Kareena, to help towards the appeal set up by her family for the operation and additional costs including for physiotherapy afterwards. Posted April 08, 2017 14:13:32 A Perth woman with cerebral palsy said she was being forced to sit an extra test or risk losing the driver's licence she has held for 36 years. Kerry Allan-Zinner, 53, has been driving since she was 17 and has a blemish-free record. But for the first time, what had previously been a routine licence renewal hit a snag and she was asked to prove she was fit to drive. "I invite you to walk around my car, find a scratch, find a dent, find something that says this person could possibly be a danger to herself or to others," she said. "There is no valid reason for me not to have my licence processed." She said she was being unfairly targeted because of her condition. Cerebral palsy affects the muscles and does not worsen over time. "It is static, so whilst my lifestyle changes the damage that is my disability does not change," she said. Ms Allan-Zinner holds an F class extension on her licence because she previously helped run a limousine service, where she was paid to drive.
