DNA clue to Brooklyn Bridge flag gag

Posted: Published on July 26th, 2014

STORY HIGHLIGHTS (CNN) -- New York police have collected DNA evidence in the case of nighttime acrobats who replaced two American flags atop of the Brooklyn Bridge with two white flags, according to a law enforcement official with knowledge of the investigation Friday. The swapped-out bleached flags were spotted by construction workers at 5:30 a.m. Tuesday. The DNA was taken from tin pans used by the vandals to cover bridge lights, according to the official -- a clever move to elude detection while the flags were raised. The tin shields were held in place with zip ties. So far there is no match in existing databases where DNA evidence of solved and unsolved crimes are kept, the official added. Among other leads investigators are following are five nicknames who tipsters suggest might be associated with the incident. Investigators are trying to learn the real identities behind the nicknames or street names. It's too soon to know whether any of them were involved, the official said. The motive is unclear: Was it a stunt, prank or something more sinister? Officials have said they are looking at whoever had access or familiarity with the bridge, including maintenance workers or anyone who worked … Continue reading

DNA clears Dallas man of 1990 rape of teenager

Posted: Published on July 26th, 2014

DALLAS, July 25 (UPI) --A Dallas man who never requested DNA testing has been cleared by DNA of raping a 16-year-old girl in 1990, prosecutors say. Michael Phillips, 57, who is now in a nursing home because of sickle cell anemia, spent 12 years in prison for the crime. He was jailed for another six months after his release because he failed to register as a sex offender. Phillips is believed to be the first person in the United States cleared by DNA without requesting a test. "I never imagined I would live to see my name cleared," Phillips said in a statement given through the Dallas County District Attorney's Office. "Six of my siblings died from the same disease, so I think God for sustaining me in prison. I always told everyone that I was innocent and now people will finally believe me." Craig Watkins, who has been district attorney since 2007, set up a conviction integrity unit. The mismatch in the Phillips case came up during a systematic check of evidence from some 1990 rape cases. "DNA tells the truth, so this was another case of eyewitness misidentification where one individual's life was wrongfully snatched and a violent … Continue reading

People use just 8.2 percent of their DNA, study finds

Posted: Published on July 26th, 2014

More than a decade has passed since the completion of the Human Genome Project, the international collaboration to map all of the "letters" in our DNA. The huge effort led to revolutionary genomic discoveries, but more than 10 years later, it's still unclear what percentage of the human genome is actually doing something important. A new study suggests that only 8.2 percent of human DNA, or about 250 million of these so-called DNA letters, are functional, and more than 2 billion are not. The results are higher than previous estimates of 3 to 5 percent, and significantly lower than the 80 percent reported in 2012 by the Encyclopedia of DNA Elements Project (ENCODE), a public research project led by the U.S. National Human Genome Research Institute to study the role of the 3 billion total letters in human DNA. [Code of Life: Photos of DNA Structures] The differences may stem from the nuanced definition of "functional DNA," said the study's co-lead researcher Chris Ponting, a professor of genomics at the University of Oxford in England. "[The ENCODE project] counted all pieces of DNA on which some protein activity occurred, whether or not that activity was useful to the cell," Ponting … Continue reading

Texas man exonerated through DNA testing he didnt know was going to happen

Posted: Published on July 26th, 2014

In 1990, Michael Phillips was convicted of raping a 16-year-old girl at a motel in Dallas, Tex., where they both lived. Phillips pleaded guilty because, he said later, his attorney told him that as a black man who had beenaccused of raping a white teenager, he should try to avoid a jury trial. He went to prison for a dozen years and, after his release, spent another six months in jail after failing to register as a sex offender. Now, nearly a quarter of a century after he was convicted,Phillipss name is being cleared. And, in an unusual twist, he didnt even realizeit was happening. Hundreds of people have been exonerated through DNA testing, according to the Innocence Project. This week, theoffice ofCraig Watkins, the Dallas County district attorney, announced that Phillips, 57, was going to join their ranks. Phillips, though, was not aware that DNA testing was going to prove his innocence, nor was he seekingsuch tests or pushing for an exoneration. He is the first person exonerated by a prosecutors office without doing these things, according to Watkinss office and the National Registry of Exonerations. This is different from other exonerationsin a very importantway, saidSamuel R. Gross, editor … Continue reading

Dallas man set to be exonerated in 90 rape after DNA clears him

Posted: Published on July 26th, 2014

A 57-year-old man who served 12 years in prison is scheduled to be exonerated Friday after DNA testing proved he did not rape a 16-year-old girl at a Dallas motel in 1990, Dallas County District Attorney Craig Watkins said. Michael Phillips, who uses a wheelchair because of debilitating sickle cell anemia, would be the first person in the United States exonerated even though he was not actively requesting DNA testing or proclaiming his innocence, according to the DAs office and the National Registry of Exonerations. I never imagined I would live to see my name cleared, Phillips said in a news release Thursday. Six of my siblings died from the same disease, so I thank God for sustaining me in prison. I always told everyone that I was innocent and now people will finally believe me. Phillips will become the 34th person exonerated in Dallas County since 2001, when post-conviction DNA testing was approved by the state, athough not all of the countys exonerees were cleared by genetic testing. DNA testing also identified the culprit in this case. DNA tells the truth, so this was another case of eyewitness misidentification where one individuals life was wrongfully snatched and a violent … Continue reading

Justice delayed: Texas man first to be cleared by DNA review of old rape kits (+video)

Posted: Published on July 26th, 2014

In a Dallas courtroom Friday morning, justice finally came to Michael Phillips, an African-American man who served 12 years in prison for a rape he didnt commit. The Phillips exoneration is the first in the United States to result from a systematic review of old DNA evidence, rather than from an investigation prompted by a convicted person actively seeking to prove his innocence, reports the National Registry of Exonerations at the University of Michigan in Ann Arbor. I never imagined I would live to see my name cleared. I always told everyone I was innocent and now people will finally believe me, Mr. Phillips said in a statement. At the hearing Friday, Dallas County district attorney Craig Watkins formally sought Phillips' exoneration. State District Judge Gracie Lewis said his conviction should be vacated. The exoneration is expected to be formally approved by the Texas Court of Criminal Appeals in the next month or two, and then Phillips will have the option to apply for compensation. Texas offers $80,000 for each year of wrongful imprisonment. Phillips is 57 and has struggled to find work and places to live since his release from prison in 2002. He is also struggling with illness. Mr. … Continue reading
