DNA subject of hearing in double death case

Double-murder suspect Kelvin Lee Coleman, 37, leaves the room after making his first court appearance via video camera at the Marion County Jail on Wednesday, March 13, 2013. Attorneys for a man charged with killing two people at the Vacation Host Inn are asking for more information after DNA from one of the victims was discovered on a gun collected at the home where the defendant was arrested. On Monday, parties involved in the case of Kelvin Lee Coleman Jr., 38, stood before Circuit Judge Robert Hodges for a hearing in the case concerning two defense motions. The defense asked for the state to turn over phone records and DNA information that are part of the states documents in the case, known as discovery. Coleman was arrested March 13, 2013, the day after he was accused of fatally shooting Lester Carter, 42, and Glendora Johnson, 54, at the Vacation Host Inn located off South Pine Avenue in Ocala. Coleman has pleaded not guilty in the case and told the Star-Banner in January that he was not at the Inn on the night of the murder. Several witnesses have identified Coleman as the shooter. Monte Sereno murder case casts doubts on DNA evidence

It looked bad for homeless alcoholic Lukis Anderson when DNA evidence tied him to a Silicon Valley millionaire's 2012 murder. But when Anderson's lawyer proved that paramedics who had treated him on the streets of downtown San Jose inadvertently transferred his DNA to the Monte Sereno murder scene, she didn't just clear him. The case is believed to be the first in California and perhaps the nation in which DNA evidence was shown to have falsely placed an innocent person at the scene of a crime, lending credibility to defense lawyers who struggle to convince jurors to view DNA evidence more skeptically. "Before, we just had hypotheticals, stuff that DAs would say was smoke and mirrors," said Deputy Public Defender Kelley Kulick, who handled the groundbreaking case. "Now, there is a case to support it." Among defendants now pointing to Anderson's case in hope of clearing their own names are former Santa Clara County Supervisor George Shirakawa Jr., whose lawyers are challenging felony criminal charges that he was behind a fraudulent campaign mailer allegedly bearing his DNA on the stamp. DNA expert testifies at murder trial

MASON CITY | Four blood spots on the blue pajama bottoms worn by John Snyder Jr. on the day he died contained DNA belonging to someone other than the child or his father, John Snyder Sr. Michael Cisneros, 38, is on trial for first-degree murder in the July 1994 death of the Mason City toddler. According to Marie Sides, a retired DNA expert with the Iowa Division of Criminal Investigation, fewer than one in 100 billion unrelated individuals would be expected to have the same DNA profile. In her testimony, Sides did not link the sample to Cisneros. DNA profiles were not able to be developed on four blood spots found on Little John's pajama top. DCI lab expert Erica Ng is now testifying about the CODIS, the statewide DNA database. Ng said a search of the database is run every week. Cisneros was arrested after a CODIS match between his DNA sample and evidence in the case turned up. Earlier Monday, a retired Mason City police detective testified John Snyder Sr. punched a desk when he was notified that the body of his missing son had been found. New law: Iowa to expand DNA collection from criminals

Lynch, The Gazette CEDAR RAPIDS Iowa law enforcement officers are about to get what Johnson County Sheriff Lonny Pulkrabek calls a valuable and important tool that will help close very important cases. However, a civil liberties advocate calls the collection of DNA from people who commit relatively low-level crimes invasive, expensive and unnecessary and said the process diverts time and money away from more serious cases. The Tuesday implementation of the law that calls for collecting DNA samples from people convicted of aggravated misdemeanors has reignited a debate over how to maintain the proper balance between community safety and constitutional freedoms. That was reflected in passage last year of the bill 84-15 in the House and 29-20 in the Senate. Opponents to the bill were a collection of some of the Legislatures most liberal and conservative members. Iowa, as with several states, collects DNA from felons. Last year, the Legislature voted to expand that to adults convicted of most aggravated misdemeanors. The effective date was delayed until this year to allow law enforcement agencies to prepare for implementation. Pulkrabek has no qualms about sampling and no doubts about its benefits.
