DNA twist frees rape suspect — for now

A suspect in two heinous rapes crimes that had Hub college women frightened to walk alone in the fall of 2004 left court yesterday a free man because of a rare technicality where DNA tests could not differentiate him from his identical twin. Dwayne McNair, 33, of Jamaica Plain and Dedham, was released from an eight-count indictment that charged him with raping two young women with an accomplice, Anwar Thomas. Prosecutors attempted to use a newly developed, state-of-the-art DNA test they said could determine whether Dwayne McNair was the rapist. The test is said to be precise enough to distinguish his DNA from that of his identical twin, Dwight McNair. Dwayne McNair already had been in jail for nearly two years, and Superior Court Judge Christine McEvoy said the test which could take months to complete would deprive him of a fair and speedy trial. My concern is the delay in the case based on the request being made so late in the case, McEvoy said, referring to the fact that prosecutors asked for the new DNA test two weeks before yesterdays trial date. Highland Avenue by the U.S. Marshals Task Force and transported to the Madison County Jail. The task force is compromised of deputy U.S. Marshals and investigators from the Jackson Police Department's Gang Unit and Metro Narcotics Unit. Taylor is scheduled to be formally arraigned via video link at 8 a.m. Wednesday in Jackson City Court on charges of first-degree murder of Staten in perpetration of attempted aggravated robbery and attempted aggravated robbery of Staten's girlfriend. Around 5 p.m. on Nov. 15, 2012, Staten's girlfriend had just arrived at the home she shared with Staten at 173 Lealand Lane. While the woman was outside, a masked man came from the side of her duplex and approached her with a gun. The man then ordered the woman to go inside her home. The woman began to scream causing Staten to come to from inside the home with a gun. Staten and the robber exchanged gunfire, and Staten was struck. Newport News man seeks DNA testing in 1994 murder conviction

Daily Press Reporter Ashley Speed Visits Deerfield Correction. NEWPORT NEWS A Newport News man is asking a judge to order DNA testing in a murder he was convicted of nearly 20 years ago. The man says the results will prove he wasn't the killer. Nathaniel Pierce, 44, filed a motion this month asking Newport News Circuit Judge David F. Pugh to order DNA testing for 23 shell casings and six items of clothing gathered as evidence in the shooting death of Steven Anthony Smith. Smith, 19, was gunned down on July 12, 1994. Pierce, his brother Darryl Hunter and Reginald Fletcher were all convicted in the fatal shooting. Hunter and Fletcher also say they are innocent. Since the shooting, four witnesses have recanted their statements in affidavits, saying they lied about Pierce's involvement in the crime. "They didn't have no evidence to prove I was even at the scene of the crime," Pierce said during a recent interview at Deerfield Correctional Facility in Southampton County. "All the guys' testimony was different. Nothing linked me to the crime. The only thing that linked me to the crime was a guy lying." Contact Information Available for logged-in reporters only By Karen McNulty Walsh | April 28, 2014 Newswise Using principles of energy transfer more commonly applied to designing solar cells, scientists at the U.S. Department of Energys Brookhaven National Laboratory have developed a new highly sensitive way to detect specific sequences of DNA, the genetic material unique to every living thing. As described in a paper published in the journal Chemistry of Materials, the method is considerably less costly than other DNA assays and has widespread potential for applications in forensics, medical diagnostics, and the detection of bioterror agents. The sensors weve developed use a light-absorbing polymer to amplify the fluorescent signal of a dye that emits light only when it binds between two matched pieces of DNA, said Mircea Cotlet, a physical chemist at Brookhavens Center for Functional Nanomaterials, who led the research and who is also an adjunct professor at Stony Brook University. The system is sensitive enough to detect individual mismatches between the bases that make up the rungs of the twisted-ladder DNA double helix molecule, making it highly specific with no false positives, Cotlet said.
