Meningitis outbreak sparks call for regulation

An outbreak of fungal meningitis has infected 91 people in the US and killed nine. The US Centers for Disease Control and Prevention said this week that 13,000 people could be at risk. The outbreak has been linked to contamination of a steroid drug sold across 23 states. The New England Compounding Center (NECC) in Framingham, Massachusetts, which produces the steroid, has recalled 17,676 vials and is working with the US Food and Drug Administration (FDA) to identify the source of contamination. Meningitis is a potentially fatal inflammation of the brain or spinal cord, most often caused by bacteria or viruses. In the current outbreak, however, it appears two fungal species are to blame. Compounding pharmacies normally combine drugs prepared elsewhere to create bespoke versions for individual patients. But some, like the NECC, have moved on to produce drugs on a larger scale. They are exempt from standard FDA regulations. The FDA has sought to restrict such pharmacies from advertising their products but the Supreme Court overturned this in 2002. Target to Hire in Canadian Stores

Martin Paul Bean III of Boca Raton, Florida is facing federal charges for selling more than $7 million worth of misbranded and unapproved oncology drugs through a San Diego pharmacy, the Latin American Herald Tribune reports. Bean was indicted last week on 35 charges of wire fraud, mail fraud, selling unapproved and misbranded drugs, illegal importation, and money laundering. He faces the forfeiture of $7 million in proceeds from the scheme, a Jaguar automobile, and up to 131 years in prison. The scheme involved the importation of drugs from India, Turkey, and Pakistan. Customers called into a center in Winnipeg, Canada, where doctors submitted orders for the drugs by phone, fax, or e-mail. The orders were then filled and mailed with an invoice from a local wholesale pharmacy to mislead the purchasing physicians into believing the drugs were approved for use in the United States. This investigation uncovered a very serious public health threat and should serve as a warning to those who put consumers at risk for their own financial gain, Derek Benner, special agent in charge for Homeland Security Investigations in San Diego, told the Herald Tribune. Swing Coffee Roasters current facility in a bleak industrial section of Alexandria has been an increasing source of irritation for owner Mark Warmuth. The isolation from potential drive-by customers. The influx of auto body shops. The lack of parking. Hes been looking to flee the space for years now, almost since he bought the historic Swings in 2006. Feds say Boca Raton man sold $7 million in unapproved cancer drugs

In August 2010, a suburban Boca Raton man sent an email to his California and Canada co-workers, warning them that undercover FDA investigators might be on to their business of selling unapproved cancer drugs to doctors throughout the United States. Martin P. Bean III didnt find it necessary, however, to halt the illegal business he ran from his home or stop wire transfers of millions of dollars in profits to bank accounts in and outside the country. Those allegations are spelled out in an indictment filed Sept. 6 in federal court in the Southern District of California. Bean, 63, faces a multitude of charges, including the sale of unapproved drugs and misbranded drugs, mail and wire fraud. He is accused of buying cancer drugs that were never approved in the United States and labeling them as FDA-approved. Bean bought the drugs the majority of which were the generic form of name brands from international sites, including India, Pakistan and Turkey. He would then sell them to doctors all over the country, including Boca Raton, Jamestown, N.Y., Illinois and San Diego.
