Ms. Kinning’s Fosamax lawsuit was filed on January 30, 2012, in the Superior Court of New Jersey, Atlantic County Division, and names Merck Sharp & Dohme Corp. f/k/a Merck & Company, Inc. and Teva Pharmaceuticals as Defendants (Docket No. ATL-L-000795-2012-MT)

According to Ms. Kinning’s lawsuit, she was first prescribed Fosamax on or before July 1, 2004, and used the medication as prescribed, and in a foreseeable manner through 2010. On or about February 13, 2010, Ms. Kinning was diagnosed with a right femur fracture. Her lawsuit alleges that Ms. Kinning’s long-term use of Fosamax for over five years caused her to be permanently and severely injured. As a result, she requires and will require future and ongoing medical care. The complaint further alleges that Ms. Kinning would not have used Fosamax had the Defendants properly disclosed the risks or side effects associated with its long-term use.

According to Ms. Kinning’s Fosamax lawsuit, over the past few years, there have been an increasing number of reports of patients suffering stress factures as a result of severely suppressed bone turnover as a result of long-term Fosamax use. The complaint further alleges that the Defendants knew of the significant risk of severely suppressed bone turnover, brittle bones, and multiple stress fractures associated with long-term use of Fosamax, but did not sufficiently warn consumers, the Plaintiff, her doctors or the medical community

The complaint charges the Defendants with negligence; breach of implied and express warranties; three counts of strict liability; fraudulent concealment; negligent misrepresentation; unfair and deceptive trade practices; three counts of violating the New Jersey Products Liability Act, including defective design, manufacturing defect, and failure to warn; and violation of the Wisconsin Deceptive Trade Practices Act. The lawsuit seeks, among other things, actual damages in an amount to be determined at trial, and punitive damages under Common Law, the New Jersey Products Liability Act and the New Jersey Punitive Damages Act.

What is Fosamax?

Fosamax, known generically as alendronate, is an oral bisphosphonate that limits bone loss by inhibiting the breakdown of old or damaged bones. In 1995, the U.S. Food and Drug Administration (FDA) approved the use of Fosamax, and since then it has been used to treat osteoporosis, osteopenia, Paget’s Disease and other conditions. In October 2010, the [fda.gov/drugs/drugsafety/ucm229009.htm] FDA ordered the makers of Fosamax and other bisphosphonates to add information about the risk of atypical femur fractures to the “Warnings and Precautions” section of their labels. The FDA ordered the label change after a study involving over 300 women who sustained such fractures found that 94 percent had taken a bisphosphonate. Most had been on the drugs for five years or more.

Alonso Krangle LLP offers free lawsuit evaluations to any Fosamax user who suffered a femur fracture that could be associated with long-term use of this drug.
